    The Davis-Bacon Act (DBA) requires the payment of prevailing wage rates, as determined by the U.S. Department of Labor (DOL), to all laborers and mechanics on most Federal construction projects costing more than $2,000.

    The following information is provided as a resource to contractors and subcontractors working on construction projects covered by Federal Davis-Bacon prevailing wage and reporting requirements.

    Contractor's Guide to Davis-Bacon
    This guide explains what is required of contractors and subcontractors working on construction projects covered by the Federal Davis-Bacon prevailing wage and reporting requirements.

    Construction Categories: Definitions and Examples
    Before selecting the proper wage determination for a project, the appropriate construction category must be determined. This document defines the four categories of construction (e.g., building, heavy, highway, or residential) and provides assistance to contractors and/or subcontractors in determining the particular type of construction a project falls under.

    Wage Determinations/General Decision
    A wage determination, as defined by the Department of Labor (DOL), is "a list of wage rates and fringe benefit rates for each classification of laborers and mechanics, which the Administrator of the Wage and Hour Division of the DOL has determined to be prevailing in a given area for a particular type of construction (e.g., building, heavy, highway, or residential)."

    Payroll Form
    This form must be completed weekly by contractors and/or subcontractors for each employee working on a project covered by Davis-Bacon requirements.

    Record of Employee Interview (HUD-11)               En Espanol
    This form is used by the City's Contract Compliance Officer to record information gathered from interviews with construction laborers and mechanics to ensure compliance with the prevailing wage requirements of the Davis-Bacon and Related Acts.

    Additional Classifications or Wage Rates
    On occasion, the applicable wage determination/general decision issued by the Department of Labor does not contain all of the necessary classifications and wage rates for a particular project. If this is the case, the City's Contract Compliance Officer can submit a request to the appropriate governmental entity, on behalf of the employer or contractor, for the establishment of classifications and wage rates not included in the determination.  The Report of Additional Classification and Rate Form and Instructions is to be submitted for projects that include funds provided by the U.S. Department of Housing and Urban Development (HUD), while the Request for Authorization of Additional Classification and Rate Form is used for construction projects that do not include HUD funding.
